These cases turn on whether a digital purchase is ownership or a revocable licence. Eligibility is set by the purchase window and region in the class definition.
The ownership question in plain terms
When you buy a digital title, the storefront terms generally grant a licence to download and play it, subject to the service continuing to operate and the publisher continuing to hold distribution rights. That is different from owning a disc. When a title is later delisted or access ends, the practical difference becomes visible, and that is the gap consumer suits have pushed on.
What this means for your library
Delisting normally removes a title from sale without removing it from accounts that already bought it. Loss of access is the rarer and more serious case, and it is usually tied to a publisher losing an underlying licence, such as music or a sports federation deal. Keeping a local backup of installed titles does not defeat a licence check, but it does protect you against download servers retiring.
The four checks that separate a real notice from a fake
- Find the case number and the court. Every court-approved settlement notice carries both. A notice with neither is not a notice.
- Read the class definition, not the headline. The definition states exactly which customers, purchases or dates are covered. It is the only thing that decides whether you qualify.
- Match the domain. Administrators run one dedicated domain per settlement. Compare the URL printed on the notice against any link you were emailed. Fakes copy the branding but never the domain.
- Confirm the deadline at the source. Deadlines come from the court order. A deadline that appears only in an email and nowhere on the official site is a pressure tactic.
Legitimate versus fraudulent, side by side
| Legitimate settlement | Red flag |
|---|---|
| Filing is always free | Any fee, deposit or card details required |
| Asks for a claim ID from your notice | Asks for full Social Security number or bank login |
| Dedicated settlement domain | Generic domain or a link shortener |
| Publishes the court-approved documents | No case number, no court named |
| Deadline matches the court order | Urgent deadline found only in the email |
If you already handed over information
If you entered card details, ask your issuer to reissue the card rather than only disputing a charge. If you entered a Social Security number, place a free fraud alert with any one of the three credit bureaus, which obliges the other two to match it. Report the notice itself to the FTC so the domain gets flagged for everyone else.
Before you file
Export your purchase history from the account portal. Claim forms reference transaction records, and access to that history can be interrupted if the account is closed or region-locked.
